Terms of use
Diese Übersetzung dient nur der Orientierung; rechtlich verbindlich ist die deutsche Fassung. This English translation is provided for convenience only. The legally binding version is the German one: Nutzungsbedingungen.
The short version. Basketiers is a free grocery list. You can use it without an account. You only need an account to share lists — and what you share is visible to the people you invite. We provide the app as it is; there is no uptime guarantee. These terms are deliberately short.
1. Scope and parties
These terms apply to use of the Basketiers mobile app and the basketiers.de website. The other party is the person named in the Impressum (referred to below as “we” or “the provider”).
Obtaining the app through the Apple App Store or Google Play is additionally subject to that store operator's terms. Where those terms conflict with these, the store terms prevail for obtaining and updating the app. Towards consumers, these terms are used only to the extent that they withstand review under §§ 305 ff. BGB (German standard terms law).
2. What Basketiers is
Basketiers is a shopping and pantry list. Lists are kept in your device's private storage; the app works without an account and without a network connection. Two features use the network: sign-in via Clerk and sharing lists via Supabase. Details are in the privacy policy.
The app is free. There are no in-app purchases, no subscriptions and no advertising. There is no entitlement to particular features, to extensions or to a particular version.
3. Contract
The contract for use comes about when you download and use the app as intended. Using it without an account requires no registration and no personal data. Sharing lists requires an account; signing in is voluntary.
4. Account and your responsibility
- You are responsible for the email address used to sign in belonging to you and for having access to it. The account and invitations are tied to it.
- Keep your credentials secret. Sign-in runs through Clerk; we never see your password.
- An account is intended for one person. Do not pass it on or let anyone act in your name.
- You can delete your account at any time — in the app under Settings → Delete account, or on the delete account page. That ends this contract.
5. Shared lists
When you share a list, that list is transferred to a server, and every person you invite who accepts can read and edit it. Changes appear for the others while a connection exists.
As the owner you can invite people and remove them again. If you remove someone, their entry remains as a revoked invitation with their email address (see the privacy policy, section 4).
If you delete your account, the lists you own are deleted — for everyone you shared them with. That happens immediately and without asking. If a list is to survive, it must not depend on your account.
Only invite people who are happy to be invited. You are responsible for being allowed to use an invited person's email address.
6. Acceptable use
Not permitted:
- entering content that breaks the law or third-party rights, or harassing other people
- attacking, overloading, systematically scraping or circumventing the security of the app or the services behind it
- reverse-engineering or modifying the app, except where mandatory law (such as § 69d UrhG) permits it
- sending invitations to people who do not want them
- reselling the app commercially or presenting it as your own service
On a breach we may remove content and block or delete accounts. For serious breaches that happens without prior notice.
7. Your content
The content you enter remains yours. You grant us only the right to store and transmit it as far as necessary to provide the features — in particular to make a shared list visible to its members. That right ends when you delete the list or your account.
We claim no ownership of your content and do not use it for our own purposes.
8. Availability
The app is provided as it is. No particular availability, freedom from errors or fitness for a particular purpose is promised; there is no uptime guarantee.
We may change the app, remove features or discontinue provision. If we discontinue provision entirely, we will announce that in the app's release notes beforehand. Local lists on your device keep working even if server features go away.
Because lists live on your device, backing up your data is your responsibility. If the device is lost or the app is deleted, the local lists are gone.
9. Liability
We are liable without limitation for intent and gross negligence, for damage to life, body or health, for fraudulently concealed defects, and for damage covered by an assumed guarantee. Liability under the Product Liability Act remains unaffected.
For simple negligence we are liable only for breach of essential contractual obligations — obligations whose fulfilment makes proper performance of the contract possible at all and on whose observance you may regularly rely. In that case liability is limited to the foreseeable damage typical for the contract.
Any further liability is excluded. In particular we are not liable for data lost through uninstallation, device loss or deletion of an account, nor for decisions you make on the basis of prices or quantities in the app.
This follows § 309 no. 7 BGB. Liability for intent, gross negligence and for life, body and health cannot be excluded, and is not excluded here.
10. Changes to these terms
We may change these terms where necessary for legal or technical reasons. The change will be announced in the app or on this website in advance; for existing contracts it applies only once you agree or continue using the app after the announcement. If you object, you can delete your account and stop using the app.
11. Term and termination
You may end use at any time without notice by deleting your account and uninstalling the app. We may terminate the contract with reasonable notice; for serious breaches (section 6) without notice.
After termination, server-side data is deleted as described in the privacy policy. Local lists on your device remain until you delete them.
12. Dispute resolution
The provider is a private individual and does not act as an entrepreneur within the meaning of § 14 BGB. There is no obligation to take part in dispute resolution proceedings before a consumer arbitration body, and the provider is not willing to do so. Details are in the Impressum.
If something is wrong, please write to us first at hallo@basketiers.de. For an app this size that is almost always the fastest route.
13. Governing law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected (Art. 6(2) Rome I Regulation).
If a provision of these terms is invalid, the rest remains valid. The statutory rule replaces the invalid provision.
